A bench of Justices Surya Kant and Ujjal Bhuyan took note of a dozen criminal cases registered against a man who made the demand. anticipatory bail Claiming that all these cases are related to various land disputes and the police are harassing him and his family members. Senior advocate Rana Mukherjee, appearing for the UP government, told the bench that on one hand the accused has not joined the investigation, while on the other hand he is demanding protection from arrest.
The bench said that though the Supreme Court has protected him from arrest, he fears that as soon as he appears before the police, he will be arrested in a fresh case registered against him.
The bench said, “The UP Police is entering a dangerous area. You register criminal cases in purely civil disputes. Tell your DGP that if this practice is not stopped immediately, we will pass such stringent orders that “He will remember that for the rest of his life.” ,Expressing displeasure. Mukherjee said that if the police did not obey the court, he would return the case to the government. The bench said the comments were targeted at the conduct of the police and told Mukherjee that he should use his good offices to drive home the message of the Supreme Court.
The bench asked the UP Police to send summons to the accused on his mobile phone, mentioning the date, time and place where he has to appear before the investigating officer. “The petitioner shall not be detained in the cases registered against him or in any new case without the prior permission of the Supreme Court,” it said.
